U.N. top court backs workers' right to strike in landmark labor ruling

International Court of Justice says strikes are protected under a core ILO convention, resolving a long-running dispute.

The United Nations’ top court ruled that workers have a protected right to strike under one of the core treaties of international labor law, in a landmark advisory opinion likely to influence labor disputes, union rights and industrial relations debates worldwide.

By a 10-4 vote, the International Court of Justice said on Thursday that strike action is protected under the International Labor Organization’s 1948 Freedom of Association and Protection of the Right to Organize Convention, commonly known as Convention No. 87.
